Polish SEZ Regime to Have Broader Application for Companies

Written by: Editor

The preferential regime for conducting business in Poland’s Special Economic Zones will be expanded to other areas outside of these pre-defined locations. The change will be implemented following a Governmental decision and Polish companies will be able to apply for the special permits starting with the second quarter of the year. This is an important change for companies in Poland and one that has the potential to attract more foreign direct investments. Our Polish lawyers talk about how the regime will apply and highlight the main aspects regarding the current Special Zones.

Poland, a special investment area in itself

The special economic zones, with until recently were only a number of fourteen separate, uninhabited parts of the country, provided for preferential conditions for investments in the form of tax incentives and different other benefits for companies incorporated in those locations. Now, with the expansion of the preferential regime, Poland could largely be considered a special economic zone in itself.

Once the SEZ regime will be expanded, a Polish company will be able to benefit from the different advantages based on a permit. Although special clarifications on the qualifying criteria have yet to be released, it is likely that companies will have to undergo a comprehensive screening procedure. Among the criteria that will be taken into consideration will be the type of investment and its location, the size of the company and the number of new jobs the respective company will bring to an area (correlated with the rate of unemployment in that location).

Our team of attorneys in Poland can help you understand the current criteria for qualification under the SEZ regime and will be able to help you apply for a permit once this is possible.

The highlights of the Polish SEZ regime

The purpose of the Special Economic Zones in Poland is to increase economic development in selected areas, to create new jobs and to attract foreign investors. The benefits which are currently available in the 14 zones but will be expanded to the rest of the country include an income tax exemption, a real estate tax exemption and other benefits for companies.
